NIBCO PEX tubing, fittings, and clamps have been accused of being defective and causing water leaks and consequential damage to homes and buildings. In 2018, a class action settlement was reached for $43.5 million to compensate class members for these losses.
Who is eligible to file a claim?
If you have owned or occupied a residential or commercial structure in the United States at any time since January 1, 2005, that contains or contained NIBCO PEX tubing, fittings, or clamps and have unreimbursed costs or damages resulting from water leaking from one of these products, or if you have repaired or paid to repair damage resulting from water leaking from one of these products in one of these structures, you may be eligible to file a claim.
The settlement excludes leaks caused by improper installation or anything for which the products themselves weren’t at fault, such as nails that may have poked through the tubing.
How do I file a claim?
To file a claim, you must submit a Claim Form and supporting documentation, such as receipts and invoices for repairs, to the NIBCO PEX Settlement Administrator. The Claim Form can be found on the settlement website: https://www.pexsystemsettlement.com/
The deadline to file a claim is November 29, 2023.
What are the benefits of the settlement?
The settlement provides for a $43.5 million fund to compensate class members for their losses. Class members may be eligible for reimbursement for the cost of repairing or replacing NIBCO PEX products and any surrounding property that suffered water damage because of a leak, plus the cost of labor.
The settlementalso allows class members to submit claims for leaks that occur up to six years after the settlement’s effective date, which has yet to be finalized.
What are the alternatives to filing a claim?
If you do not file a claim, you may still be able to pursue legal action against NIBCO individually. However, this option is more expensive and time-consuming than filing a claim under the settlement.
If you have suffered water damage due to a leak from NIBCO PEX tubing, fittings, or clamps, you may be eligible to file a claim under the $43.5 million class action settlement. The deadline to file a claim is November 29, 2023.
